Article 1: General Conditions
The e-commerce website olefació offers its customers the opportunity to purchase the products from its online shop.
These Terms of Use ( "Terms") apply to any order placed by a visitor to this e-commerce website ( "Customer"). When placing an order via the webshop olefació, the Customer must explicitly accept these conditions, whereby he accepts the applicability of these Conditions, excluded all other conditions. Additional conditions by the customer are excluded, unless they are prior, written and expressly accepted by olefació.
Article 2: Price
All prices are in EURO, always including VAT and any other mandatory fees or taxes payable the customer.
If delivery, reservation or administrative costs will be charged, this is mentioned separately.
The indication of price only refers to the articles as described. The accompanying pictures are decorative only and may contain elements that are not included in the price.
Article 3: Offer
Despite the fact that the online shop and website is made with the utmost care, it is still possible that the information is incomplete, contains material errors, or is not up to date. Obvious mistakes or errors in the offer do not bind olefació. Concerning the accuracy and completeness of the information olefació is only held to an obligation of means. Olefació is not liable in case of obvious material errors or printing errors.
If the customer has specific questions about eg. size, color, availability, delivery, or delivery method, we ask the customer contact us in advance.
The offer is valid while supplies last and can be changed or withdrawn by olefació at any time. Olefació can not be held liable for the unavailability of a product. If an offer has a limited duration or is subject to conditions, this will be explicitly stated in the offer.
Article 4: Online purchases
Our products can be purchased through our webshop. Desired items and desired quantities can be selected and added to the basket "ADD TO CART".
The customer has the possibility to check the details of his provisional order and correct any errors.
The CHECKOUT is done in five steps:
1. customer info-'CUSTOMER INFORMATION '
The customer complete his e-mail address and can optionally choose to subscribe to our email list. The customer presses 'CONTINUE' to continue.
2. shipping info 'SHIPPING '
The customer can select the shipping option after completing the shipping address. The customer presses 'CONTINUE' to continue.
3. Conditions 'TERMS OF SERVICE'
The customer is considered to accept the contents and the conditions of the order in full knowledge of the facts and in particular of these Terms of Use. The customer accepts the terms and presses 'CONTINUE' to continue.
4. Payment Data 'PAYMENT '
The Customer may choose between the following payment methods: Credit Card, Apple Pay or Paypal
After entering the card details and billing information the customer presses 'CONTINUE' to continue
5. control and data acquisition
Here all the data can be checked and correctedone last time . Untill now, the customer can still cancel the purchase and exit the procedure. The sale is considered final upon confirmation of the order by the customer when pressing 'PURCHASE ', notwithstanding the right of cancellation by the customer (the terms of which are described below). This order will be confirmed by olefació by sending an e-mail to the customer containing all the data previously provided by olefació.
The customer will be sent a second e-mail when sending his order.
Olefació recommends the customer to keep these two e-mails. The customer should be aware that these two e-mails will be sent to the email address entered by the customer at its registration prior to placing the order. Olefació can therefore not be held liable in case of an incorrect entry of the email address in question or non receiving the order confirmation e-mail.
Olefació is entitled to refuse an order in response to a serious shortcoming of the Customer with respect to orders where the Customer is involved.
Article 5: Delivery and execution of the agreement
Items ordered through the online store can be shiped in Belgium, Netherlands, Luxembourg, France, Germany and Italy. For deliveries in countries not listed here the client should contact olefació via one of the contact details mentioned on this website.
Delivery is done by the service selected by the client in point 2 of the CHECKOUT procedure.
Unless otherwise stated or expressly agreed, the goods will be delivered to the place of residence of the Customer within 30 days of receipt of the order.
For your information and without being bound to this time, the average delivery time, starting from the day of the shipment confirmation e-mail, is estimated at:
Belgium: 1-2 working days
Netherlands:2-3 working days
France: 3-4 working days
Luxembourg: 3-4 working days
Germany: 3-4 working days
Italy: 3-4 working days
Austria: 3-4 working days
Spain: 3-4 working days
UK: 3-4 working days
During public holidays, holiday season and/or special promotion periods the delivery can possibly be delayed.
These delivery times apply if the customer orders an item which is in stock and provided the customer pays with one of our payment options.
Any visible damage and/or significant deficiency of an article or other failure upon the delivery must be reported immediately to olefació by the Customer .
The risk of loss or damage shall pass to the customer from the moment he (or a third party, other than the carrier, designated by him) has acquired the physical possession of the goods. The risk, however, passes already to the customer upon delivery to the carrier, if the carrier was instructed by the customer to carry the goods and that choice was not offered by olefació.
Article 6: Retention of title
The delivered items remain the exclusive property of olefació until the moment of complete payment by the customer.
The Customer commits, if necessary, to point to the retention of title of olefació to anyone who would e.g. claim the not yet fully paid articles.
Article 7: Right of withdrawal
The provisions of this Article apply only to customers purchasing products online at olefació as consumers.
The Customer has the right to withdraw from the contract within 14 days without giving any reason.
The withdrawal period will expire 14 calendar days after the day on which the Customer or Customer's designated third party other than the carrier, acquires the physical possession of the goods.
To exercise the right of withdrawal, the Customer must inform olefació of his decision to withdraw with an unambiguous statement in writing by post or email. The customer can use the attached withdrawal model form, but is not obliged to do so.
To comply with the withdrawal period, the customer must send its notice on exercising the right of withdrawal before the withdrawal period has expired.
The customer must promptly return the goods , in any event no later than 14 calendar days after the date of communication to olefació of his decision to withdraw. The Customer is on time, if he sends back the goods before the deadline of 14 calendar days has elapsed.
The direct cost of returning the goods are on the customers behalf.
If the returned product in any way impaired, olefació reserves the right to establish the liability of the Customer and demand compensation for any loss of property resulting from the use of the goods by the Customer that goes beyond what is necessary to establish the nature, characteristics and functioning of the goods.
Only items that are in their original packaging with all accessories, instructions and invoice or receipt, can be returned .
If the customer cancels the contract, olefació will refund to the customer all up to that point received payments from the customer, including the default delivery, within a maximum of 14 calendar days from the date olefació has recovered all goods, or from the date the customer has demonstrated that he has returned the goods, whichever comes first.
Olefació pays the customer with the same payment as the Customer has performed the original transaction, unless the client expressly agreed otherwise. In any case, there will be no fee charged to the Customer for such refund .
The Customer may not exercise the right of withdrawal for deliveries of customer-specific goods or goods clearly intended for a specific person.
Article 8: Warranty
You benefit the legal guarantee of conformity and hidden defects of the delivered products, under the law of September 21, 2004 on the protection of consumers in consumer sales.

Article 10: Penalties for non-payment
Without prejudice to the exercise of other rights which olefació has, the customer is due to pay, in case of non- or late payment, from the date of default and without notice, an interest of 10% per year on the unpaid amount. Moreover, the customer automatically and without notice is due a compensation of 10% on the amount in question, with a minimum of 25 euros per invoice.
Notwithstanding the foregoing, olefació retains the right to take back the not (fully) paid items.

Article 13: undermining validity and non-withdrawal
If any provision of these Terms be invalid, illegal or void, this will in no way affect the validity, legality and applicability of the other provisions.
Failure at any time by olefació to enforce any of the rights set out in these Terms, or also to exercise any right of this, will never be seen as a waiver of such provision, and will never affect the validity of these rights.
Article 14: Amendments to the conditions
These conditions are supplemented by other terms which are explicitly refered to. In case of contradiction, the present Conditions prevail.
Article 15: Evidence
The Customer agrees that electronic communications and backups can serve as proof .
Article 16: Applicable law - Disputes
Belgian law is applicable, except for the provisions of international law concerning applicable law.
The courts of the place where the consumer is, is entitled to legal disputes.
The consumer can also turn to the ODR platform ( http://ec.europa.eu/consumers/odr/ ).
